The EasyMerch app (here and after referred to as “App”) is provided to legal entities (such as companies and organizations) by its developer PRONETKOM, Ltd. (here and after referred to as “Company”) and used by field employees defined as individual users (physical persons) who have an employment relationship with the aforementioned legal entities.
The Company acknowledges the importance of personal data protection, and takes the responsibility to protect personal data collected from users in accordance with the terms and conditions specified herein, as well as the legislation of the Russian Federation (in particular, with the Federal Law FZ-152 "On Personal Data" dated on 27 July 2006). Before installing and using the App, please read the foregoing document carefully.
The document applies to all processes of collecting, recording, systematizing, accumulating, storing, revising (updating, changing), extracting, using, transferring (providing, accessing), and deleting personal data.
1.1 The following terms and definitions are used in this document:
System — the merchandising automation system, EasyMerch.
App — the mobile app of the merchandising automation system.
Company — PRONETKOM, Ltd. which is the developer of the merchandising automation system.
Customer — a legal entity (company or organization), who signed a license agreement for providing a non-exclusive license for the merchandising automation system.
User — a physical entity who has an employment relationship with the Customer and has access to the App through an account purchased and provided by the Customer.
2.2 Personal data is referred to as:
2.2.1 Personal information about the User, including their first name, last name, phone number, job position and other data.
Since registration is not available from the App itself, the User is unable to sign up by themselves. Registration is performed by the Company representatives with the User’s personal data provided to the Company by the Customer considering the terms and conditions of the labour contract signed between the User and the Customer. The App itself does not collect this type of personal data.
2.2.2 The data that is automatically transferred to the services of the App while the User is using the App, technical specifications of the equipment and software used by the User, date and time of the access to the services and other information required to ensure the proper functioning of the App. Such information is not considered personal and is not confidential, as well as it does not identify the User. It is used only to improve user experience and develop new features of the App.
2.3 In order to be able to use the App properly, the User should provide it the following permissions:
2.4 The App can get access to the aforementioned services only after receiving the relevant permission from the User.
2.5 The App collects any information the User provides when filling in any fields in the App, informing us about the App malfunctions, or sending messages through the App.
2.6 The App collects the information about the User’s mobile device, including the unique device ID, IP address, OS version, etc.
2.7 This document is only applicable to the EasyMerch app.
2.8 The Company assumes that the User provides true and complete information when required in the App and that the User is keeping the information up to date.
3.1 Data processing refers to actions (operations) with the User's data, including the collection, systematization, accumulation, storage, revision (update, change), use, distribution (including cross-border transfer), depersonalization, and deletion of personal data.
3.2 The App collects and stores data that is necessary to ensure the correct functioning of the App.
3.3 The data received from the User is processed by the App for the following purposes:
3.3.1 To ensure the proper functioning of the App.
3.3.2 To receive feedback from the User, including requests regarding the use of the App, changes in the App functionality, the release of the App updates.
3.3.3 To determine the location of the User to implement the function of monitoring the field staff.
3.3.4 To provide technical support to the User in case of problems related to the use of the App.
6.1 Since the Company receives personal information about the User from the Customer, and the User and the Customer have signed the labour contract, deletion and changing the information through the App is impossible.
6.2 The consent on processing personal data was given by the User to the Customer. Considering this, in order to withdraw your consent on processing personal data the User should contact the Customer directly.
7.1 The Company reserves the right to make changes to this document at any time and without preliminary notice and the consent of the User.
7.2 A date of the last update is specified at the beginning of this document. The User takes the responsibility to visit this page periodically to check for possible updates.
7.3 If you continue using the App after updates in this document are made, it is considered that you have read and accept all the new or revised terms and conditions.
8.1 The original version of this document is in Russian and can be provided in English for referrence.
8.2 In case of any inconsistency in the Russian and English versions of the document, the Russian version should have the priority.
